Mill Creek Flood Plain Bylaw

An affidavit by Denciti's Gusack spells it out with clarity. The Mill Creek Flood Plain Bylaw No. 10248 is a regulation by the City of Kelowna that manages development and construction in areas prone to flooding along Mill Creek.

The bylaw stipulates Kelowna must address ‘duty of care’ to its citizens regarding floodplain hazard management. It isn't optional. Since the 'duty of care' is entrenched in the bylaws, any scheme by Denciti in partnership with the City of Kelowna must be subject to flood zone planning before it can go into effect.

The Province bowed out of flood management, meaning the only stop for citizen safety is the always conflicted City of Kelowna.
