Land Exchange Agreement - Denciti Kelowna Springs

The devil in the Kelowna Springs steal is in it's gory details.
The City of Kelowna released, with heavy redactions, the 33 page deal with Denciti. Here. Somebody should call the cops.
Dyas tried the bum's rush before what turned into a 7 hour public hearing on the fate of Denciti's rezoning application. Council was asked to hold off on a vote until after the October election, or wait for floodplain environmental studies and for a valuation for the commercial land being given away.
Supporting the steal were the Chamber of Commerce, Denciti, Construction Associations and firms, real estate agents, and Sandher Fruit Packers. Corrupt politicos from the Khalistani Tom Dyas cabal were not interested in delay. Written comments were submitted by the public Here. All were ignored.

Kelowna pickleballers call out Dyas - revisited

Theme of Tom Dyas and Denciti for the Kelowna Springs steal was the need in Kelowna for pickleball courts. Servicing pickleballers was the rally cry for paving over Kelowna Springs. The newest all weather pickleball facility in Kelowna is the Pickle and Paddle Athletic Club's 33,000 sq. ft. facility near the Kelowna airport at 2045 Matrix Cres.
The facility was announced July 7th and will open in September. Its a 5 minute drive from Kelowna Springs. Cost to Kelowna taxpayers is zero. The new facilty came about through a simple zoning change. "10 indoor pickleball courts are for casual play, competitive leagues, and everything in between." A week after this annoucement, mayor Tom Dyas blows something past $4m of taxpayer money for pickleball courts on the Kelowna Springs flood plain.

In addition, on June 30 Kelowna council approved rezoning for a 12-court indoor pickleball facility at 2092 Enterprise Way. The project by Argus Properties transforms their vacant industrial space into courts. By the end of 2027 the Parkinson Recreation Center will add 24 courts, 12 of them indoor.
A letter published on Castanet exploded the conmen's false narrative months ago. "Dencity’s offer is not free."

"The association already allocates all the money it receives from their members. The pickleball association did not go to Dencity (to ask for a pickleball facility), Dencity went to it for its endorsement as a large group. Most of the players do not support this development on this land."

Pickleball needs no specialized buildings. Virtually any empty space is fine. Since there is an inexhaustible supply of that in Kelowna, only a criminal would build courts with taxpayer money. Tom Dyas's lies have been many and obvious. He is a conman. The all-in taxpayer cost of the Dyas Kelowna Springs give-a-way is potentially over $100m, and the project has always been a Khalistani legacy project of the corrupt Colin Basran.
Under Tom Dyas, taxpayers are paying for facilities that aren't needed, are competition to the new courts, are to be built over a greenspace flood plain, and are a part of a Khalistani backed conspiracy that robs taxpayers of multi-millions for no benefit.

Dissidents in Kelowna sue on Kelowna Springs rezoning - update IV

We have obtained the City of Kelowna reply. Here.
It seems to us these liartards extraordinary are admitting in pleadings to the flawed process of their client.

Two plaintiffs of the Kelowna Springs court challenge have bowed out. Susan Ames and David Buckna filed notices of discontinuance on June 29. The prospects of a 'David versus Golliath' senario and high legal costs has probably frightened them off.
Three plaintiffs remain attached to the legal challenge — Alexandra Wright, Randy Kozek and Lorel Pearce. Susan Ames is a previous candidate for council, losing in 2022. David Buckna is a prolific commentator and letter writer. Wright, Kozek and Pearce are seeking an injunction preventing the city from advancing the development application until the process of full disclosure of all material information occurs. Here.

Shakers on Kelowna council are in a burning rush to pass their Kelowna Springs grift. Despite a petition being filed in BCSC, there is no sign of any slowdown, and this with a civic election months away.
The city agenda says a bylaw vote was scheduled. It is curious that Dyas and his team are doing a bum's rush on their Kelowna Springs project while legal documents are being filed by the kilo.
Dyas has no public mandate to jam his reeking Kelowna Springs steal through in his final months as mayor. The disposition of the Kelowna Springs steal must be handled by the politicos who will replace Dyas and his cadre of thieves in 4 months.

Dyas is a lame duck, and this we suggest is the reason why his masters want Kelowna Springs approved before the barking dog is de-elected.

The Kelowna Springs rezoning steal is going in front of a judge for a review. A group of justifiably POed citizens have filed a petition seeking a procedural review of the rezoning decision. Here.

"2. A declaration that the Respondent conducted the public hearing process in a manner contrary to the principles of procedural fairness and contrary to the requirements of the Local Government Act;"

Mountains of technical information, critical to making a proper decision vis-a-vis flood zone planning, was only included at the 11th hour and wasn't attached. There was no opportunity to review that material by counsellors, some of whom had already been bought. NO rationale for the outrageous steal/land swap was ever offered by bureaucrats. How one justifies Kelowna taxpayers swapping useless land for industrial meant for their bus depot for 1/20th of its value wasn't touched.
The most obvious omission was land valuations for the swap. It is inherently impossible to make a proper decision where valuations are unknown and undisclosed. The deal is so bad it appears those numbers were withheld on purpose.
