Ryan Nixon - update IV

The Nixons are required in court on Friday in response to a 'short notice' application. Should they fail to show, or show up and lose, their builder's lien will likely be removed.

As for 3036 Appaloosa Road the dust causing drywall is gone, but the asphalt and concrete has increased exponentially. Nixon will likely start grinding that next, turning the residential area into an industrial zone.
The latest in Nixon Land is a petition in BCSC. What's um, the deal?

Part 1: ORDERS SOUGHT

1. The claim of lien filed by the respondent, Melvin Ernest Nixon dba Kelowna’s TNT Trucking (“Nixon”), in the New Westminster Land Title Office under number HB22091 (the “Nixon Lien”) against those lands and premises known and described as: PID: 032-086-041 Lot 1 Section 29 Township 26 Osoyoos Division Yale District Plan EPP128152 (the "Lands") and any related Certificates of Pending Litigation ("CPL") be cancelled from title ..."

Explanation? The Nixons filed a Lis Pendens (builder's lien) on a former customer's property. The low bidder Nixons overcharged and did substandard work. They then disputed their chargebacks. A Lis Pendens on file squelches those with an interest, of which High Road Glenmore is the primary one. They are suing the Nixons to remove the LP and for damages, along with 2 or 3 creditors.

The High Road Apartments is a 50-unit, five-story purpose-built rental development by Beech Westgard Developments Ltd., located at 1885 High Road in the Glenmore area of Kelowna.
The 43,000-square-foot project was slated for completion in Summer 2026. 8 months ago there was talk of work stopping and the project being halted. Its current status is unknown.

1885 High Road was offered for sale at $1.8m. The windowless building, if progressing at all, is doing it slowly.
-------------------------------------------------------------

Ryan Nixon has a reputation around Kelowna, and not just with his many creditors.
We have the latest from 231 Tilley Road. Reprobate Ryan Nixon SURELY isn't picking up any of his construction debris and SURELY won't be paying somebody to do it for him. This appears to be crushed concrete, and requires proper disposal.
Often sued and with many outstanding default judgments, 3036 Appaloosa Road isn't the only Okanagan property Ryan Nixon is operating illegally from in the wide open.

Nixon will never pay any fines for continuously destroying the environment, he'll be bankrupt long before then.
Also at that industrial location we have DirtPro Excavating. https://dirtproexcavating.ca/

Alexandra Martin invites RDCO councillors for coffee - update

Ryan Nixon's TNT Trucking and father Melvin Ernest Nixon have received a default judgment in BCSC in the amount of $85,458.08 plus interest of $4,326.75, and costs in the amount of $1,137.14. The fly by night operation will NOT be paying for any remediation for the ALR land they have destroyed over 9 years at 982 Old Vernon Road in Kelowna. HERE
As well as refusing to enforce city bylaws, Kelowna did $50,116.57 in business with TNT Trucking in 2022, and at least $43,366.66 in 2023. This is the price of incompetent Kelowna City staff, councillors, and mayor Tom Dyas. This is the cost of incompetent RDCO trustees, incompetent and corrupt ALR employees including Dave Birchmore, and incompetent and conflicted Provincial and Federal elected officials. This is what Kelowna citizens get. Hello Councillors,
I know you are busy – and, per Castanet, eager to start the holiday season – but I am following up on this request to confirm you received it and are working to protect the citizens of RDCO. More than a few of you represent both the City of Kelowna and RDCO; just a reminder to those wearing dual hats that they have a duty to act in the best interests of the citizens of the RDCO. Presumably you will recuse yourselves from any vote where you don’t feel you can represent RDCO’s interests with the proper standard of care, and not sacrifice the “country mice” in favour of those big city mouse developers.

I invite you all to sign my petition – there are only 1530 signatures so far, but of course that is without any marketing endeavours thus far. https://www.change.org/p/save-kelowna-springs-greenspace-updated-2025-petition

Ms. DeHart – I, too, extend an invitation to everyone to come and join me for a coffee at my property. You can admire my view of the City-sanctioned gravel pit at the same time.
Regards,
Alexandra Martin, B.A., J.D.

982 Old Vernon Road in Kelowna has been turned by Ryan Nixon and the Kandolas into an environmental disaster zone.
Ryan Nixon of TNT Trucking has operated an illicit soil remediation business at the ALR property of Jeetender S. Kandola and Manraj K. Kandola for over 9 years. TNT operates at least a dozen dump trucks and offers demolition, excavation, landscaping supplies, waste removal, crushing and screening, waste bin rentals, soil remediation and concrete disposal.
All TNT activities are banned from ALR ground and have never been permitted there. The required zoning for Nixon's business has always been industrial. (I1, I2, I3, and I4) Here.

Alexandra Wright/Martin penned an open letter to Regional District of Central Okanagan directors in November after the Tom Dyas announcement of his Kelowna Springs steal. Here
"I am writing to request you provide urgent attention to the proposed land transfer and future development at Kelowna Springs Golf Club, as explained by Kelowna Mayor Tom Dyas to Castanet Nov. 22.

While the land is within Kelowna city limits, its development poses a direct threat of flooding to RDCO farmland and rural residents. This is not a speculative concern, it affects livelihoods, property and the safety of our community.

I urge the regional board to:
• Immediately assess flood risks to RDCO lands.
• Engage and inform affected residents without delay.
• Coordinate mitigation efforts with the City of Kelowna prior to the issuance of any approvals.
• Maintain full transparency so the public fully understands the potential impact to RDCO of this proposed development.

The RDCO has a duty to protect residents from preventable harm. Please act now before irreversible damage occurs.
Alexandra Wright"
Part of the problem is that Kelowna Mayor Tom Dyas, and several of his hand picked conflicted councillors, are members of the RDCO board. Here
